The BT FON Mexican Wave (the Mexican Wave) is a promotion by British Telecommunications plc (BT) presenting the opportunity for participants to submit a video in any of the following formats: 3GP, MOV, AVI, MP4, MPG (Video) of them or group of friends, teams, colleagues etc. performing a Mexican wave.

Participants under 18 years old must have parental (or guardian) consent to participate. BT may request to see a copy of such permission at any time.

By uploading Video to or using this website you accept of these Terms of Use (Terms). These Terms are governed by and will be interpreted in accordance with English Law and any disputes relating to these Terms will be subject to the exclusive jurisdictions of the English courts.

Ownership of Content and Licence

The service and all content on the website is owned by British Telecommunications plc (BT) and its licensors and is subject to copyright. You may not reproduce, distribute, transmit, print or transfer content of the electronic message on any tangible medium or otherwise exploit the content in any way, except for the purpose of sending the electronic message using the service.

Submitted Material

You confirm in relation to any Video you submit:

the Video is your original work and that it is not copied in whole or in part from or infringes any other copyright work
you have the full written consent of every person who appears in the Video or has participated in the preparation or production of the Video.
BT will use the Video and combine it with others to create online Mexican Waves. If BT chooses to produce, publish or create a finished work which includes all or part of your Video ("Finished Work") you grant to BT whether by BT itself or on BT’s behalf an irrevocable royalty free licence to use, copy, modify, adapt, perform, exhibit, transmit, broadcast, publish and communicate to the public the Video and any Finished Work for any corporate communication, advertising or publicity purposes.

You also confirm that the Video shall not contain any inappropriate material including, but not limited to, images or references to nudity, pornography, sexually explicit content, offensive language or behaviour. Such content will not be accepted and submission of such material may result in BT contacting the appropriate legal authorities.

Exclusion of Liability

BT accepts no responsibility for any errors, deletions, non-delivery, interruptions or mis-delivery of any communications produced on this website or any content produced by the sender. This is within the control of the sender and their sole responsibility. BT does not guarantee that the message you send from the website will reach the intended recipient. BT does not monitor or exercise control of transmissions sent by third parties using this website.

Except as provided to the contrary in these Terms and to the extent permitted by law, BT excludes all liability of any kind, whether due to negligence or otherwise in respect of content or materials available on the website. BT reserves the right to cease or make changes to the website at any time, without notice. BT does not exclude any liability for personal injury or death caused as a result of its own negligence.

Restriction on Use

You may use the service for your personal non-commercial use only. You must not send an email to any mailing lists. Furthermore, you must ensure before entering a person’s email address that you have obtained prior permission from that person to send them the electronic message on behalf of BT.

BT makes no representations or warranties as to the legality, propriety, accuracy, correctness or reliability of the content of any message or Video you send or receive. You will take all reasonable steps to ensure that your equipment and software are protected against damage from using this service or the website. You acknowledge that your use of the website is at your own risk.

Indemnity

You agree to indemnify BT against any and all claims asserted against BT by third parties as a result of your use of the website in breach of these Terms.

Privacy

If you are visiting any of BT’s websites or using any BT services, by continuing to do so, you indicate your agreement to our use of your personal information as set out in BT’s privacy policy.

What does this privacy policy cover?

This privacy policy only applies to how BT deals with your personal information. It does not apply to any other company or to any other company’s websites even if you access them through BT. If you disclose your personal information to other companies your information will be dealt with according to their privacy practices.

BT may post any Video on the BT FON area located in YouTubeTM or any other similar sites. By submitting Video you permit BT to do this and accept that the images contained within Video may be shown on third party sites.

Complaints

Please note that BT does not control the text or imagery contained in any message sent using the service.
